Banning Partial Birth Abortion

Partial Birth Abortion is a method of terminating a pregnancy is a women is too advanced to abort through other measures.  Usually, a woman who seeks an abortion before the fifth month can be treated using a minor medical procedure or medications that allow the cervix to dilate and the uterus to contract. 

This contraction process expels the fetus in a similar method as a miscarriage.  However, if a woman waits until she is in her fifth month of gestation or later, a dilate and extract procedure must be performed.  This procedure has raised significant controversy and prompted the United States government to ban the procedure in 2003. .

A partial birth abortion involves the dilation of a woman’s cervix, allowing a doctor to extrude the fetus from the uterus feet first.  As the fetus is being removed from the womb, a surgical tool is inserted into the back of the head and the neural tissue is extracted through a vacuum tube.  Once this extraction process is completed, the rest of the fetus is removed after the head contracts.  In November of 2003, President George W. Bush signed the Partial Birth Abortion Ban Act of 2003.  This ban prevents the procedure to be performed legally in the country by any doctor of physician.  There are certain exemptions from this ban, including scenarios if the child has died within the womb and needs to be extracted, a complication has risen during pregnancy and a women’s life is at risk if the pregnancy is allowed to continue, or if the child is so deformed that it will die upon birth. 

The signing of the Partial Birth Abortion Ban of 2003 has changed the way the law regards this method of pregnancy termination.  Many pro life individuals feel the law will hamper the pro life movement and encourage further legislation regarding abortions.  The bill was passed through the House of Representatives with an overwhelming vote of 281 to 142.  Sixty-three Democrats joined the mostly Republican vote, encouraging the non-partisan act.  The Senate passed the bill with a vote of 63 to 34, again with Democrats joining the mostly Republican vote to pass the bill.
